Apostille for China from California: Skip the Consulate Appointment Entirely
For families in Los Angeles, the San Gabriel Valley, the Bay Area, and San Diego: if you are still refreshing a consulate appointment page, stop — for most Hague-path documents headed to mainland China, the consulate is no longer part of the process.
The appointment scramble is over
The Los Angeles and San Francisco consulates served the largest Chinese community in America, and appointment slots were scarce. For many document types, that consular step was replaced when China entered the Hague Apostille Convention.
What changed in November 2023
China’s accession to the Hague Apostille Convention (in force with the U.S. from November 7, 2023) replaced the old consular-legalization route for Hague pairs. For documents headed to mainland China, the common U.S. path is: notarize (when the document is private), then obtain an apostille from the Competent Authority that can touch that signature — usually a Secretary of State. No Chinese consulate appointment for that Hague path. Always confirm the receiving office in China still wants that object.

How it works — remote notarization, then SOS
Remote online notarization — about a half hour on video from wherever you are. Passport + credential/biometric IDV when there is no SSN file (do not keep retrying a quiz that looks for a Social Security file). Details:remote online notary without a Social Security Number
Apostille the Secretary of State authenticates the notary’s signature and office. I do not issue the apostille. On a Montana-notarized private file, Montana’s current public how-to is electronic intake of the RON/IPEN, paper apostille out, SOS fee $10, normal processing 3–5 business days from receipt. That is not the same thing as “email me a Montana Hague e-APP PDF.”
Format the desk will file — some Chinese windows want paper; some can use a true SOS e-Apostille from a state that actually issues one. “I live in California — is a Montana notarization valid for China?”
With remote online notarization, the notarial act is performed under the notary’s commissioning state. A Montana (or Nevada) commissioned RON can be the first step when that state’s SOS is the right Competent Authority for that notarial act. It does not turn a California public record (for example a California vital record or a California school record sold as the school’s apostille) into a Montana public document. Wrong object = bounce. Confirm document type before you pay.
Your residence, visa status, and whether you have an SSN do not change that split.
California’s three common China-bound private files
Property powers of attorney — often a private POA for a sale or management in China. Confirm the housing bureau’s required template first, then RON, then apostille
Inheritance / family declarations — often notarized in the same session as a related POA when the attorney’s package says so.
No-SSN signers — H-1B/L-1 spouses, new arrivals, F-1 students: biometric/passport path instead of a dead KBA quiz.
An honest note on e-Apostille acceptance in China
HCCH says a valid e-Apostille must not be refused merely because it is electronic. The receiving desk can still, under its own rules, want the underlying document in paper. We do not invent which 民政局 or housing bureau takes a US PDF this week. Tell me the city and the office; I will tell you what we can prove from official pages and what you must confirm with them.
